PRIVACY POLICY
GENERAL PROVISIONS
1.1. This offer is an official proposal by 2021 SOLUTIONS LLC, hereinafter the «Seller», to conclude a Contract for the sale of goods by distance means, that is via the Online Store, hereinafter the «Contract», and places the Public Offer (proposal) on the Seller’s official website https://bzik.com.ua (hereinafter the «Website»).
1.2. The moment of full and unconditional acceptance by the Buyer of the Seller’s proposal (acceptance) to conclude an electronic contract for the sale of goods is deemed to be the Buyer’s payment for the order on the terms of this Contract, within the periods and at the prices stated on the Seller’s Website.
1.3. The terms of this Contract are the same for all Buyers, whether a natural person, a legal entity or a private entrepreneur.
TERMS AND DEFINITIONS
2.1. In this offer, unless the context requires otherwise, the terms below have the following meanings:
* «Goods» — models, accessories, components and accompanying items;
* «Online Store» — under the Law of Ukraine «On Electronic Commerce», a means of presenting or selling goods, work or services by way of an electronic transaction.
* «Seller» — the company selling the goods presented on the Website.
* «Buyer» — a natural person who has concluded a Contract with the Seller on the terms set out below.
* «Order» — the selection of individual items from the list of goods specified by the Buyer when placing the order and making payment.
SUBJECT OF THE CONTRACT
3.1. The Seller undertakes to transfer ownership of the Goods to the Buyer, and the Buyer undertakes to pay for and accept the Goods on the terms of this Contract.
This Contract governs the purchase and sale of goods in the Online Store, including:
— the Buyer’s voluntary selection of goods in the Online Store;
— the Buyer’s independent placing of an order in the Online Store;
— the Buyer’s payment for an order placed in the Online Store;
— processing and delivery of the order into the Buyer’s ownership on the terms of this Contract.
ORDER PLACEMENT PROCEDURE
4.1. The Buyer may place an order for any item presented on the Online Store’s Website.
4.2. Each item may be included in the order in any quantity.
4.3. If an item is out of stock, the company’s manager must notify the Buyer (by telephone or e-mail).
4.4. If an item is unavailable, the Buyer may replace it with a similar model, decline that item, or cancel the order.
ORDER PAYMENT PROCEDURE
5.1. Payment is made at the Buyer’s discretion:
in cash,
by bank transfer,
by electronic payment,
via a payment terminal.
5.2. Payment is made in hryvnia.
5.3. If funds are not received, the Online Store reserves the right to cancel the order.
5.4. An order is deemed paid from the moment funds are credited to the current account of the Seller or its representative. Payment of an Order constitutes the Buyer’s agreement to the terms of this contract.
DELIVERY TERMS
6.1. The Seller delivers the order after the Goods have been paid for in full.
6.2. The price of Goods stated on the store’s website may be changed by the Seller unilaterally. The price of Goods already ordered by the Buyer is not subject to change.
6.3. Documents required by the legislation of Ukraine are provided to the Buyer together with the order.
RIGHTS AND OBLIGATIONS OF THE PARTIES
7.1. The Seller has the right:
— to unilaterally cease providing services under this contract if the Buyer breaches its terms.
7.2. The Buyer is obliged:
— to pay for and receive the order in good time on the terms of this contract.
7.3. The Buyer has the right:
— to place an order in the Online Store;
— to require the Seller to perform the terms of this Contract.
LIABILITY OF THE PARTIES
8.1. The Parties are liable for failure to perform or improper performance of the terms of this contract in the manner provided by this contract and the current legislation of Ukraine.
8.2. The Seller is not liable for:
— any change to the appearance of the Goods made by the manufacturer;
— minor discrepancies in the colour of the goods, which may differ from the original solely because of differing colour reproduction on particular models of personal computer monitors;
— the content and accuracy of information provided by the Buyer when placing an order;
— delays and interruptions in the provision of Services (order processing and delivery) arising from causes beyond its control;
— unlawful acts committed by the Buyer using this access to the Internet;
— the Buyer’s disclosure of network identifiers — IP, MAC-addresses, login and password — to third parties;
8.3. In using the Internet access granted to them, the Buyer is solely liable for harm caused by their actions (personally, even if another person was using their login) to persons or their property, to legal entities, to the state or to principles of morality.
8.4. In the event of force majeure, the parties are released from performing the terms of this contract. For the purposes of this contract, force majeure means events of an extraordinary, unforeseen nature that preclude or objectively impede performance of this contract, the occurrence of which the Parties could not have foreseen or prevented by reasonable means.
8.5. The Parties will make every effort to resolve any disagreements solely through negotiation.
OTHER TERMS
9.1. The Online Store reserves the right to amend this contract unilaterally, provided it is published in advance on the website https://bzik.com.ua .
9.2. The Online Store is created to organise the distance sale of goods via the Internet.
9.3. The Buyer is responsible for the accuracy of the information given when placing an order. By accepting (placing an order and subsequently paying for the goods), the Buyer gives the Seller unconditional consent to the collection, processing, storage and use of their personal data within the meaning of the Law of Ukraine «On Personal Data Protection».
9.4. The Buyer’s payment for an order placed in the Online Store constitutes the Buyer’s full agreement to the terms of the contract of sale (public offer).
9.5. The actual date of the electronic agreement between the parties is the date the terms are accepted, in accordance with Article 11 of the Law of Ukraine «On Electronic Commerce».
9.6. Use of the Online Store to preview goods and to place an order is free of charge for the Buyer.
9.7. Information provided by the Buyer is confidential. The Online Store uses information about the Buyer solely for processing the order, sending notifications to the Buyer, delivering the goods, settling payments and similar purposes.
PROCEDURE FOR RETURNING GOODS OF PROPER QUALITY
10.1. Goods are returned to the Online Store in accordance with the current legislation of Ukraine.
10.2. Goods are returned to the Online Store at the Buyer’s expense.
TERM OF THE CONTRACT
11.1. An electronic contract is deemed concluded from the moment the person who sent the proposal to conclude it receives a reply accepting that proposal, in the manner determined by part six of Article 11 of the Law of Ukraine “On Electronic Commerce”.
11.2. Before it expires, this Contract may be terminated by mutual agreement of the parties up until the goods are actually delivered, by refunding the money.
11.3. The Parties may terminate this contract unilaterally if one of the parties fails to perform the terms of this Contract and in the cases provided for by the current legislation of Ukraine.
